Terms of Service – Kindlr

These Terms of Service (“Terms”) govern your access to and use of the Kindlr mobile application and related services (“Kindlr,” “we,” “our,” or “us”). By creating an account or using Kindlr, you agree to these Terms.

If you do not agree, do not use Kindlr.

1. Eligibility

Kindlr is available only to individuals aged 18 or older.

By using Kindlr, you represent and warrant that:

  • You are at least 18 years old
  • You are legally permitted to use the service
  • You have not been previously permanently banned from Kindlr

Accounts belonging to users under 18 will be terminated immediately.

2. Accounts & Registration

  • You may create one account only.
  • You must provide accurate, current, and complete information.
  • You may not impersonate another person, create fake accounts, or misrepresent your identity.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Location-Based Service

Kindlr is a location-based service. By using Kindlr, you consent to:

  • Collection and storage of approximate location data (latitude and longitude)
  • Use of location data to match you with nearby users

Location access is required to use Kindlr. Exact location is never shared with other users.

4. User Content

a. Ownership

You retain ownership of the content you submit, including photos, bios, messages, and prompts.

However, you understand that:

  • We may remove or delete your content at any time
  • Deleted content may be permanently removed
  • We do not sell user content

b. License to Kindlr

You grant Kindlr a non-exclusive, royalty-free, worldwide, limited license to host, store, analyze, modify (including resize and crop), display, and distribute your content solely to operate, improve, and moderate the service.

This license ends when your content is deleted from Kindlr.

5. Prohibited Conduct

You agree not to engage in any of the following:

a. Illegal or Harmful Conduct

  • Sexual exploitation or abuse of minors (zero tolerance)
  • Human trafficking
  • Threats of violence or credible harm
  • Harassment, stalking, or intimidation
  • Hate speech or discrimination based on protected characteristics
  • Doxxing or sharing private information without consent
  • Fraud, scams, or impersonation

b. Sexual Content Restrictions

Text-based NSFW content between consenting adults is permitted where legal, but you may not:

  • Share non-consensual sexual content
  • Share sexual content involving minors
  • Share sexual content obtained illegally
  • Share sexually explicit images that violate Kindlr’s content rules

All images are subject to moderation.

c. Platform Abuse

You may not:

  • Use bots, automation, or scraping tools
  • Circumvent moderation or enforcement systems
  • Attempt to reverse-engineer or exploit the service
  • Create multiple accounts
  • Interfere with other users’ experience

6. Moderation & Enforcement

Kindlr uses automated tools and human review to enforce these Terms.

We reserve the right to:

  • Remove content without notice
  • Limit account visibility or reach
  • Temporarily suspend accounts
  • Permanently ban accounts
  • Terminate accounts for any reason, with or without notice

All bans are reviewed by a human.

7. Messaging & User Interactions

Kindlr does not guarantee matches, responses, or outcomes.

You acknowledge that:

  • Interactions occur at your own risk
  • Kindlr is not responsible for offline conduct
  • You are solely responsible for your interactions with other users

You are strongly encouraged to use caution when meeting others in person.

8. SMS Messaging & 10DLC Compliance

If you provide your phone number and opt in to receive text messages, you consent to receive SMS messages from Kindlr at that number. These messages are limited to verification or 2FA codes you request by taking an in-app action (such as pressing a button to send a code).

  • Message frequency varies based on your activity and preferences.
  • Consent to receive SMS messages is not a condition of purchase.
  • Message and data rates may apply based on your carrier plan.
  • You can opt out at any time by replying STOP; reply HELP for help.
  • You must provide accurate, current phone number information and keep it updated.

You must pass age verification before accessing SMS enrollment or verification flows.

We do not send marketing SMS messages.

We comply with applicable 10DLC requirements, including maintaining consent records and providing opt-out mechanisms for all SMS programs.

9. Subscriptions & Payments

  • Kindlr subscriptions auto-renew unless canceled
  • Payments are processed exclusively through Apple App Store or Google Play
  • Pricing and features may change at any time
  • Refunds are governed by Apple or Google policies, not Kindlr
  • Kindlr does not process or store payment card details.

10. Account Deletion

When you delete your account:

  • Your profile, messages, and content are permanently deleted
  • Messages are deleted for both sides
  • Deletion is immediate and irreversible
  • There is no recovery period

We may retain limited records for legal, compliance, and abuse-prevention purposes.

11. Termination

We may suspend or terminate your access at any time, for any reason, including violation of these Terms or behavior that risks harm to others or the platform.

Upon termination, your right to use Kindlr immediately ends.

12. Disclaimers

Kindlr is provided “AS IS” and “AS AVAILABLE.”

We make no warranties regarding:

  • Availability or uptime
  • Matches or outcomes
  • User behavior
  • Accuracy or reliability of content

Use of Kindlr is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law:

  • Kindlr is not liable for indirect, incidental, or consequential damages
  • Total liability will not exceed the greater of:
  • Amounts paid by you in the past 12 months, or
  • $100 USD

14. Arbitration & Class Action Waiver

a. Binding Arbitration

Most disputes must be resolved by binding arbitration, not court.

b. Small Claims Exception

You may bring eligible claims in small claims court instead of arbitration.

c. Class Action Waiver

You agree to bring claims only in an individual capacity, not as part of a class or collective action.

15. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.

16. App Store Terms

If you downloaded Kindlr from Apple or Google:

  • Apple and Google are not parties to these Terms
  • They have no responsibility for the app
  • Payment disputes are governed by their policies

17. Changes to These Terms

We may update these Terms at any time. Continued use of Kindlr after changes constitutes acceptance. Material changes will be communicated through the app or website.
